Website: Conduct:
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the Website. All information, designs, drawings and other specifications provided on the Website are the exclusive property of Abey Furnishing. Any copying, transmission or re-transmission of the same requires the prior written approval of Abey Furnishing.

Price of Goods:
The price listed on the Website (the 'Price') for Abey Furnishing products (the "Products") will be as stipulated at the time when you place your order on the website. We are entitled to make adjustments to the Price to take account of any increase in our supplier’s prices, or the imposition of any new taxes or duties, or if due to an error or omission the Price for the Products on the Website is wrong.

Payment:
All payments become due at the time of order, we accept Visa, Mastercard, Debit Cards, Cheques and Cash. Cheques must be cleared before goods will be ordered/despatched and cash must be paid in person at our showroom.

Delivery:

a) Lead Time:
All of Abey Furnishing sales are special orders: - furniture ordered specially for you from the factory. The lead time quoted is an estimate based on past experience. We will endeavour to deliver the Products to you within this time/day of your Account order within mainland UK. Abey Furnishing cannot be held responsible for manufacturer delays. Abey Furnishing will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those Products. At the time of delivery you will be required to validly sign-off on the delivery of the Products, after which time the Products become your sole responsibility.

b) Delivery:
Our standard free delivery is to your door only and normally within 2-3 working days of the goods being deemed in stock, you may opt for delivery to the room of your choice by our specialised carriers they will transport your furniture directly to your home in there specially equipped furniture vans with specially trained staff and set the furniture in place in your home. There is an additional charge of £35 for this service. Deliveries by Specialised carriers takes an additional 1 week longer than our standard free deliver. Orders must be arranged for delivery within 14 days of us contacting you. A re-delivery charge will be imposed if no one is home to accept delivery and a 20% storage charge will be applied per month or part thereof unless otherwise agreed in writing with the store manager at the time of purchase.

c) Defects:
In exceptional circumstances, a product may arrive suffering minor wear and tear from the shipping process, or even a minor defect that occurred at the factory. Please note that you must report any damage immediately upon delivery by noting it on the Delivery Collection Note and emailing us on info@abey-furniture.co.uk or calling 01472 814100.

d) Sizing:
Please note the size and dimensions of the merchandise you have ordered and ensure that the item of furniture will fit in the designated room and through any passages, stairwells, landings and doorways on the way to the destination room. Abey Furnishing does not accept responsibility for any furniture that will not fit into its intended location.

Damage:
Customers must report any damage i.e. scratches, dents, chips, tears, soiling etc. immediately upon delivery. It is important that each item is carefully and thoroughly inspected by you or your authorised agent immediately upon delivery. Please note that you must report any damage immediately upon delivery by noting it on the Delivery Collection Note. Abey Furnishing will not be responsible for any damage not reported.

Colour Variation:
Whilst every reasonable effort will be made to ensure colour matches, fabrics and leather may vary due to dye lot variations. Leather and wood products will by their nature be subject to grain variations. All removable covers of a matching suite must be cleaned at the same time in order to avoid colour variations. Abey Furnishing will not be responsible for colour variations in the event that matching items are not purchased together.

Information and Specifications:
All descriptive matter, drawings, pictures, colours, specifications and advertising on the Website are for the sole purpose of giving an approximate description of the Products.

Returns & Cancellations:
When you purchase online, you have a statutory right to return a product up to 7 days after your order has been delivered (cooling off period). You can return the item to us and we will organise a refund (excluding delivery cost) Please contact our customer care support for a quote on return delivery. If an item is damaged or faulty please contact us and we will organise a replacement or refund.
Our terms and conditions do not affect your statutory rights.

Special Customised Orders:
The above 7 day return (cooling off period) does not apply to Special Customised Orders..

Ready to Assemble Items:
Abey Furnishing will not accept the return of any item which has undergone any assembly by the purchaser All items returned to Abey Furnishing must be in there original packaging and returned in same conditions as they were delivered.

Disclaimer of Warranties:
The information contained in the Website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the Website is provided "as is" and "as available" and without warranties or conditions of any kind either express or implied. We do not warrant or represent that the use or the results of the use of the materials available through the Website or from third parties will be correct, accurate timely, reliable or otherwise. We accept no liability in relation to any of the above other than as may be provided for under your statutory rights.

Limitations of Liability:
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products. In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed £150.00.

We reserve the right to change the terms of use or policies regarding the use of the Website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on the Website.

General:
We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident. Our failure to exercise or enforce any right or provision of the terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. The section titles in the terms of use are solely used for the convenience of the parties and have no legal or contractual significance.

Laws:
The terms of use shall be governed by and construed fully in accordance with the laws of the United Kingdom. You and we agree to submit to the exclusive jurisdiction of the courts located in the United Kingdom. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

Termination:
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions.
